Equipment Hire Terms & Conditions

These Equipment Hire Terms & Conditions ("Terms") govern the hire of test and measurement equipment from Eenovators Limited ("Eenovators", "we", "us", the "Owner"). By placing a hire request, paying a hire fee, or taking possession of any equipment, the customer ("Hirer", "you") accepts these Terms in full. A separate signed Hire Agreement may be required before equipment is released.

1. Ownership of equipment

All hired equipment remains the sole property of Eenovators at all times. The Hirer acquires no right, title, or ownership interest in the equipment, and must not sell, sublet, lend, pledge, or part with possession of it. The equipment must not be removed from the agreed location or country without our prior written consent.

2. Hire period and minimum hire

The hire period begins when the equipment is dispatched to, or collected by, the Hirer and ends only when the equipment is returned to Eenovators and inspected and accepted by us. A minimum billing period of one (1) week applies to all hires, even where the equipment is required for a single day. Hire is charged at the published Weekly or Monthly rate; additional days beyond the first week are charged at the published daily rate and confirmed on your quote. The Hirer remains responsible for the equipment for the full period until it is back in our possession and accepted.

3. Rates and what they exclude

Published hire rates cover use of the equipment and its standard accessories only. Unless expressly stated in your written quote, rates exclude: (a) technician / engineer time, set-up, and on-site support; (b) shipping and transport (see clause 4); (c) calibration certificates (see clause 5); (d) consumables; (e) any applicable taxes or duties; and (f) the refundable security deposit.

4. Shipping and transport

Shipping is not included in the hire rate. The Hirer is responsible for round-trip shipping costs, which are added to the quote based on the destination and the weight of the hard case and accessories (typically in the range of $30–$80, but confirmed per destination). Risk in the equipment passes to the Hirer on dispatch and remains with the Hirer during return transit until the equipment is received and accepted by us.

5. Calibration certificates

Calibration certificates are not included in the hire rate. Where a project requires NIST-traceable calibrated equipment, a calibration certificate can be provided at additional cost and must be requested before the hire begins so it can be arranged and quoted. Absent a specifically requested certificate, equipment is supplied in good working order but without a current traceable calibration certificate.

6. Security deposit

A refundable security deposit is required before the equipment is released. The deposit is set per unit and confirmed on your quote (typically tied to the equipment's replacement value). We may deduct from the deposit any amounts due for loss, damage beyond fair wear and tear, missing accessories, cleaning, or late-return charges. Any balance is refunded after the equipment is returned, inspected, and accepted.

7. Inspection on receipt

The Hirer must inspect the equipment and all accessories on receipt and notify us of any shortage, defect, or damage within 24 hours. If no notification is received, the equipment is deemed to have been delivered complete and in good working order.

8. Hirer responsibilities

The Hirer must: use the equipment only for its intended purpose and only by competent, qualified persons; follow all manufacturer operating and safety instructions; keep the equipment secure and protected from theft, weather, and misuse; not open, modify, repair, recalibrate, or tamper with the equipment or its seals; and notify us immediately of any breakdown, fault, loss, or damage.

9. Risk, loss and damage

The Hirer is responsible for the equipment from dispatch/collection until it is returned and accepted by us, and is 100% liable for any loss, theft, or damage during this period, fair wear and tear excepted. The Hirer agrees to pay the cost of repair, or, where the equipment is lost, stolen, or damaged beyond economical repair, the full replacement cost at current market price (for reference, current list prices are USD 2,900 for the AEMC PEL 113 kit and USD 1,800 for the DENT ELITEpro XC). Equipment not returned within 14 days of the agreed return date is deemed lost and charged at full replacement cost.

10. Insurance

For the full hire period the Hirer must maintain insurance covering damage to, and loss or theft of, the equipment for its full replacement value, together with third-party liability arising from its use. Eenovators may require evidence of cover and to be named as an interested party before releasing equipment.

11. Indemnity and limitation of liability

The Hirer indemnifies and holds Eenovators harmless against all claims, damages, losses, and expenses arising from the Hirer's possession or use of the equipment, except to the extent caused by our negligence. Equipment is supplied in functioning condition; to the fullest extent permitted by law we exclude liability for any indirect or consequential loss, including lost data, lost measurements, downtime, or loss of profit.

12. Return and late fees

The Hirer must return the equipment by the agreed date and time, clean and in the condition supplied, with all accessories, cases, and documentation. Late returns are charged at 1.5× the applicable daily rate for each day (or part day) the equipment is overdue, in addition to any deposit deductions. Where we are unable to collect due to the Hirer's restricted access, absence, or other act or omission, the Hirer remains liable for the equipment and ongoing hire charges until collection is completed.

13. Cancellation

Confirmed hire bookings cancelled with less than 48 hours' notice before the start date may forfeit part or all of the hire fee. Deposits for cancelled bookings are refunded in full where the equipment has not been dispatched.

14. Governing law

These Terms are governed by the laws of the State of Colorado, USA, and the parties submit to the jurisdiction of its courts. (Confirm jurisdiction with Eenovators if your hire is governed by a different region.)

15. Acceptance

Submitting a hire request, paying a hire fee, or taking possession of the equipment constitutes acceptance of these Terms. A countersigned Hire Agreement and proof of identity may be required before release of equipment.
